These Terms of Service ("Terms") govern your use of NeuroKindKids.com ("we," "us," "our," or "the Platform"). By creating an account or using our Platform, you agree to these Terms. If you do not agree, please do not use our Platform.
About Our Platform
NeuroKindKids.com creates personalized, AI-generated books where characters come to life as the hero of their own story while practicing real self-advocacy skills. Grown-ups co-author these stories with NeuroKindKids by creating a character, selecting a scenario, a challenge, and a self-advocacy skill to be featured in the story. Using details you provide — such as your character's first name or nickname and appearance — our Platform generates custom stories and illustrations using artificial intelligence. Our books are built for all children, with neurodivergent children at the center, featuring inclusive representation of kids who use mobility aids, sensory tools, and AAC devices.
On NeuroKindKids, we call your character a "Kind Kid Hero" — it's the same thing, just our friendly name for it! For clarity, these Terms of Service primarily use the term "character."
Account Requirements
To create an account on our Platform, you must:
- Be at least 18 years of age.
- Provide accurate and complete information during registration.
- Keep your login credentials secure and not share them with others.
- Be responsible for all activity that occurs under your account.
You may not create an account on behalf of another adult without their knowledge and consent. Children are strictly prohibited from creating accounts and may only access the Platform under direct adult supervision.
Children's Data & Authorization (COPPA Compliance)
By creating a character profile or entering details about a child under the age of 13, you represent and warrant that:
- You are the parent or legal guardian of the child, OR
- You are an authorized educator, clinician, or therapist who has obtained explicit, verifiable parental consent to input the child's traits and information into our Platform for educational or therapeutic purposes.
If you are utilizing our Free Tier, you explicitly acknowledge that checking our age-verification and consent box at signup serves as your formal affirmation of parental or professional authorization.
We reserve the right to immediately terminate any account and permanently delete all associated data if we discover or suspect that data belonging to a child has been provided without proper adult authorization.
What You Can Do With Your Books
When you generate a book through our Platform, you receive a personal, non-exclusive, non-transferable license to view, download, print, and share your books for entertainment and educational purposes.
You may not:
- Resell, redistribute, or commercially exploit books generated through the Platform (e.g., listing them for sale on third-party sites or charging clients a separate fee for the book itself).
- Claim the AI-generated illustrations or story frameworks as your own original independent artwork or writing.
- Use books or illustrations to create competing products or services.
- Remove or alter any NeuroKindKids branding included in the books.
AI-Generated Content
Our Platform uses artificial intelligence (currently Google Gemini for illustrations and story text and Anthropic Claude for story text) to generate personalized content. By using our Platform, you understand and agree that:
- AI-generated content is created algorithmically and may occasionally contain imperfections, inconsistencies, or errors in illustrations or text.
- We continually work to improve the quality of AI-generated content, but we cannot guarantee perfection in every illustration or story.
- AI-generated illustrations are stylized, cartoon-style representations — they are not photographs and are not intended to be exact likenesses.
- The AI services we use may change over time as we adopt improved models or providers.
- As the account holder, you are responsible for reviewing all generated books and determining their suitability before sharing them with a child.
We have implemented extensive guidelines and safety measures to ensure AI-generated content is appropriate, affirming, and respectful of neurodivergent children. However, AI technology has limitations. If you encounter content that is inappropriate, inaccurate, or concerning, please contact us immediately at hello@neurokindkids.com and we will address it promptly.
Platform as Co-Author
NeuroKindKids serves as a co-author of your child's books. You provide the character details (your Kind Kid Hero), select the scenario, challenge, and self-advocacy skill. Our Platform generates the story text and illustrations based on your selections. The resulting book is a collaboration between your input and our AI-powered creative tools.
As the account holder, you are responsible for the accuracy and appropriateness of the information you provide, including character details and scenario selections.
Subscriptions and Pricing
Our Platform currently offers:
- A Free Tier: Includes access to your very first complimentary book and the ability to save your initial character profile.
- Paid Subscription Plans: Provide ongoing access to create additional books, build an expanded library, and unlock premium features.
Subscription details, pricing, and billing terms will be clearly presented at the time of purchase. By subscribing, you agree to:
- Pay the fees associated with your selected plan.
- Authorize recurring charges at the frequency of your billing cycle (monthly or as specified).
- Cancel your subscription at any time through your account settings or by contacting us at hello@neurokindkids.com.
Cancellation and The Book Vault
You may cancel your paid subscription at any time. Upon cancellation, you will retain full access to all subscription benefits through the end of your current billing period.
Following your final billing period, your account will transition to our Free Tier, and your library will be managed as follows:
- Your First Book: You will retain permanent, unlimited access to view, download, and print the very first complimentary book you created on the Platform.
- The Book Vault: Any additional books generated during your paid subscription will be securely stored in your personal "Book Vault." You will still see these titles and covers in your dashboard, but they will be locked. To read, download, or print these locked books, you must reactivate your subscription.
- Saved Characters: Your custom character profiles and details will remain safely saved in your account so you do not have to recreate them when you choose to resubscribe.
No additional charges will be made after your cancellation takes effect. If you wish to permanently delete your account, your characters, and your entire library from our servers, you may request full data deletion at any time by emailing us at hello@neurokindkids.com.
In the event we discontinue the Platform, we will provide reasonable notice and make your full library available for download before shutdown.
Refunds
Due to the digital nature of our products and services, all sales on NeuroKindKids.com are final, and we do not offer refunds. However, your satisfaction and experience are incredibly important to us. If you are unsatisfied with your purchase or are experiencing any issues, please contact us at hello@neurokindkids.com. We will do our absolute best to work with you and find a positive solution.
Referral Program
We may offer a referral program through which you can share a unique referral link with others. If someone you refer creates an account and subscribes to a paid plan, you may receive a referral reward, such as a free month of subscription. Referral rewards are issued at our discretion, apply only to active subscriptions, and have no cash value. We reserve the right to modify, pause, or discontinue the referral program, including the structure or value of any reward, at any time.
Kind Kid Hero Archive
If you reduce your subscription quantity, you may be prompted to archive one or more Kind Kid Heroes to bring your account within your plan limits. Archiving a Kind Kid Hero does not delete their character data or books — all content is retained and associated with your account. Archived heroes and their books may be restored at any time by adding a Kind Kid Hero from your dashboard. You may also permanently delete an archived hero at any time. We are not responsible for any loss of access to archived content resulting from account cancellation or deletion.
Acceptable Use
When using our Platform, you agree not to:
- Provide false or misleading information in your account.
- Attempt to access other users' accounts, data, or books.
- Attempt to bypass security measures, rate limits, or usage restrictions.
- Use the Platform to generate content that is harmful, offensive, or inappropriate for children.
- Use automated tools, bots, or scripts to access the Platform or generate content in bulk.
- Interfere with the operation or performance of the Platform.
- Reverse engineer, decompile, or attempt to extract the source code of the Platform.
We reserve the right to suspend or terminate accounts that violate these terms.
Your Content and Data
Information you provide: You retain ownership of the information you provide about your characters (names, descriptions, preferences). You grant us permission to use this information solely for the purpose of generating your personalized books and operating the Platform.
Generated books: AI-generated books are created using our proprietary prompts, AI models, illustration guidelines, and story frameworks. While you receive a license to use your books as described above, the underlying creative systems, prompt architectures, and generation methods remain our intellectual property.
Data handling: Your information is handled in accordance with our Privacy Policy. You may request deletion of your account and all associated data at any time, unless we are required by law to retain certain information.
Intellectual Property
The Platform — including its design, code, branding, illustration guidelines, story frameworks, prompt systems, and all original content — is the intellectual property of NeuroKindKids.com and is protected by applicable intellectual property laws.
You may not copy, reproduce, or create derivative works based on our Platform, its design, or its systems without our written permission.
Disclaimer of Warranties
Our Platform is provided "as is" and "as available." While we strive to provide a high-quality, reliable service, we make no warranties or guarantees regarding:
- The accuracy, completeness, or quality of AI-generated content.
- Uninterrupted or error-free operation of the Platform.
- The suitability of generated books for any particular purpose.
Limitation of Liability
To the fullest extent permitted by law, NeuroKindKids.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to:
- Errors or inconsistencies in AI-generated content.
- Loss of data or content.
- Service interruptions or downtime.
- Unauthorized access to your account due to your failure to secure your credentials.
Our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.
Termination
We may suspend or terminate your account if:
- You violate these Terms.
- You engage in activity that harms the Platform, other users, or our reputation.
- We are required to do so by law.
- We discontinue the Platform (with reasonable notice).
You may terminate your account at any time by contacting us at hello@neurokindkids.com. Upon termination, we will delete your account and associated data within 30 days, unless we are required by law to retain certain information.
Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will notify you by email (if you have an account) or by posting a notice on our site. The "Last Updated" date at the top reflects the most recent revision.
Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the State of California. Any disputes shall be subject to the jurisdiction of the courts in the state where NeuroKindKids.com operates.
